Supreme Court grants 12 weeks maternity leave to all adoptive mothers

The court struck down a provision that imposed restrictions on maternity leave for adoptive mothers, removing limitations that denied them equal benefits

The Supreme Court of India has struck down a provision of the Social Security Code, 2020 that restricted maternity leave for adoptive mothers only to situations where the adopted child was under three months of age.


The court ruled that adoption is part of a woman's reproductive rights and said that all adoptive mothers are entitled to 12 weeks of maternity leave, regardless of the child's age. lt also asked the Centre to enact a law recognising paternity leave.
